This case was in the public eye after it was highlighted by a consumer TV program in the UK.
The cruise liner suffered damage to one of its propulsion pods on departure from Fort Lauderdale for a cruise around the Caribbean and on to Rio de Janiero. As a result, her departure was delayed and her itinerary was severely disrupted.
Many of the passengers were understandably unhappy about the changes made to their cruise itinerary and we were instructed by the shipowners and their P&I Club to advise on the legal position.
Cases that make the news have to be dealt with sensitively and a number of factors have to be balanced against each other including the passengers’ expectations and concerns, owners’ reputation, the commercial consequences and the insurance position.
Our knowledge of these all too often conflicting issues and the practicalities of the shipping, and more particularly the cruise industry, enabled us to find a solution for our clients that brought the matter to a prompt resolution.
